Queensland’s Puberty Blocker Ban Reversed by Supreme Court Ruling

In a landmark decision, the Queensland Supreme Court has overturned the state’s ban on gender-affirming care for transgender youth. The ruling marks a significant development in the ongoing debate over access to essential healthcare for transgender children and adolescents.

The case was brought forward by a parent of a transgender minor, challenging the legality of the restrictive directive. Justice Peter Callaghan delivered the verdict, declaring the directive unlawful and enabling continued access to gender-affirming treatments.

The controversy centered around a questionable process led by Director-General David Rosengren, who, on January 28th, issued a directive to publish the ban after only a brief 22-minute consultation with health service executives. Investigative reports, including those by The Guardian, revealed that this legally mandated consultation occurred simultaneously with a press conference in which the health minister publicly announced the decision—raising concerns about transparency and procedural integrity.

With the court’s decision, the Queensland Children’s Gender Service at Queensland Children’s Hospital is now authorized to accept new patients seeking gender-affirming care, including puberty blockers. The previous ban was met with widespread criticism from health professionals and advocates, who deemed it harmful and discriminatory. Federal Sex Discrimination Commissioner Anna Cody characterized the measure as both “harmful” and “discriminatory,” underscoring the importance of equitable healthcare access for transgender youth.

This ruling underscores the importance of due process and evidence-based policies in healthcare decisions affecting vulnerable populations, reaffirming the rights of transgender children to access gender-affirming treatments in Queensland.
